DUI: What You Need To Know

YOUR RIGHTS

  1. You have the right to an attorney
  2. You have a right to plead not guilty and have the State prove their case beyond a reasonable doubt
  3. You have a right to be presumed innocent until proven guilty
  4. You have a right to compel witnesses to testify on your behalf
  5. You have a right to a thorough investigation of your case
  6. You have a right to remain silent
  7. You have a right to testify on your own behalf, but you are not required to do so
  8. You have a right to get an independent test or have the specimen taken by the police retested by an independent lab
  9. You have a right to confront and cross examine the State's witnesses
  10. You have a right to appeal

DUI DO's and DON'Ts

If you are contacted by law enforcement for suspicion of DUI keep in mind the following "DO's and DON'T's":

  1. Be Courteous
  2. Provide the Officer your license, registration, and insurance
  3. Ask to speak to an attorney immediately
  4. Ask to be released to obtain an independent test
  5. Don't be rude or try to talk your way out of the situation
  6. Don't admit anything or take any field sobriety tests
  7. Don't take the eye test
  8. Don't answer any questions, use your right to remain silent
